Smoking: Smoking is not permitted in any Common Areas including the parking garage. All smoking materials shall be extinguished before entering any part of the building, including the garage.
Personal Property: Common Areas may not be used for storage of personal property except in the designated storage areas assigned to each Unit.
Use: Children shall not play in Common Areas.
Art: Artwork or signage shall not be placed in or on Common Area walls without the approval of the Board.
HOA Maintenance: The Master HOA is responsible for the general maintenance and repair of the condo hallways and condo lobby.
Owner Responsibility: Maintenance or repairs caused by owner’s (or owner’s agents or invitees) negligence or intentional misconduct shall be the responsibility of the owner.
Residential Hallway Collective Decisions
If the majority of a floor wants to replace furniture or plants, they may do so upon written simple majority of the floor owners and concurrence of the MHOA.
The cost would be shared on a voluntary basis and split as they may decide between the consenting owners. Objecting owners cannot be forced to pay.
The selection of replacement furniture would be by majority decision of the residents on the floor.
The furniture no longer used would be offered:
to other hallways (as replacement for damaged furniture upon majority vote of the new hallway owners);
offered to residents (draw straws if more than one resident wants a piece of furniture); or
offered to Habitat for Humanity (Asheville ReStore) (in this order).
If items can be stored as a possible replacement for use on another floor, this will be considered, however the storage would have to be residential storage since the hotel will not store residential items.
