Use: Units shall only be used for residential use.
Right of Access: The Community Manager or other person authorized by the Board or Community Manager may enter a unit for the purpose of correcting any condition believed to originate in a unit that threatens another unit or common element, or adversely impacts the proper operation of systems (such as fire suppression), provided such requests for entry are made in advance and at a reasonably convenient time. If the Owner is not or will not be home, the Community Manager shall arrange for someone to supervise the work to protect privacy and property. (Same paragraph is in Security and Locks.)
Emergency Access: In the case of an emergency, the right of entry without request shall be immediate whether the owner is present at the time or not. An attempt will be made to notify the Owner and/or Tenant prior to entry and to protect privacy and property. The Community Manager or engineer will always and immediately notify an Owner of emergency access.
Consideration and Respect: Depending upon the nature of the emergency access, the entering party shall take reasonable precautions to protect the privacy and dignity of an owner, resident or guest who may be in the unit.
No Email Blasts: Owners may not send email blasts to other owners without recipient consent. Consent must be a clear affirmative action, never implied or assumed. Only the Community Manager and Board may send blast announcements, alerts, etc. The Board and Community Manager are not authorized to divulge owner email or other contact information without the consent of the owner.
No Unlawful Activity: No unlawful activity shall be conducted within any Unit, nor shall anything be done thereon or therein which may be or which may become an unreasonable annoyance or nuisance to another Owner, or endanger the health and safety of any Owner. No obnoxious or offensive activity nor disorderly conduct shall be allowed which interferes with the rights, comfort, or convenience of another Owner.
Unit Maintenance: Unit Owners are responsible for the maintenance and repair of their Units. In the event of damage to or destruction of a Unit by fire or other casualty, the Owner is responsible to restore the unit so that it is usable and complies with then current building codes. Remedies for failure of an Owner to fulfill maintenance responsibilities are enumerated in Section 12.5 of the Master Declaration.
Noise: Noises or music loud enough to disturb or annoy other occupants is prohibited particularly between the hours of 10:00 PM and 8:00 AM. This includes, but is not limited to, sounds from musical instruments, CD players, phonographs, radios, VCRs, DVDs, computers, televisions, or any other devices. Owners shall at all times comply with City of Asheville ordinances regarding sound, noise and light.
Decorations: Non-offensive door decorations and/or artifacts placed immediately adjacent to a Unit entry are permitted provided they do not inconvenience or offend another Owner and comply with all fire and other building regulations.
Signs/ Window Display: No “For Sale” or “For Lease” signs, political signs, banners, flags or other advertising devices shall be displayed or visible from a Residential Unit or Common Area except as may be permitted by the Board. Nothing shall be hung on the glass railing both as a matter of safety and in compliance with this regulation. No satellite dish or antenna may be placed on the exterior of any Residential Unit.
Window Shades: The backing of window shades (whether blackout shades or 3% or 5% see-through) must be white to the outside.
Firearms and Fireworks: No discharge of firearms or fireworks are permitted in or from the building or the property.
Drones: Drones or other flying objects are not to be launched from the building without written prior permission from the Community Manager.
Smoke Detectors: Maintenance of the smoke detectors in a unit or Common Area is the responsibility of the Master Association. Tampering with, disabling, or destroying any smoke detector is prohibited.
Fires and Fireplaces: No fires shall be permitted anywhere in the Building other than in fireplaces and in accordance with the fireplace safety requirements.
No Hazardous Materials: Nothing shall be done or kept in any Unit or Common Area which will increase the cost of insurance or result in the cancellation of insurance maintained by the Association on the Building or contents thereof, without prior written consent. The storage of flammable materials and chemicals is not permitted in a Unit or Common Area; this includes individual storage units and the garage.
Light Pollution: Lighting additions and/or modifications shall not impact any other Unit.
Water Damage: Appliances and other water apparatus shall not be used for any purposes other than those for which they were constructed. Owners or their tenants are responsible for any water damages caused by their neglect or misuse.
Floor Loads: There shall be no floor load in excess of acceptable floor load applicable to the portion of the building where the load is placed. The Community Manager shall be contacted for consultation with the building engineer if anything unusually heavy is to be added to your unit.
